The Superior Court of New Jersey recently upheld a lower court decision regarding an accident involving a fallen tree onto a busy roadway, which resulted in a loss of two lives. A core component of the case involved hearing professional opinions regarding industry standards of care and the reasonable compliance with these accepted standards. Cited in the case was a Registered Consulting Arborist who refuted the Plaintiff’s expert’s opinions regarding what should constitute appropriate tree inspection protocol. The Superior Court ultimately agreed with the lower court and decided in favor of the Defendant.
The Court documents cited the ASCA website, including offering:
ASCA states it is "dedicated to providing Consulting Arborists with the tools and knowledge they need to deliver a stronger work product to their clientsAmong the list of services the ASCA claims it provides to its members are the "Diagnosis of Tree and Landscape Problems" and "Expert Witness and Litigation."
